Or at least thats the reason this Apart complex says is the reason they want all American Flags removed, bc it may be offensive to the diverse community.

Imagine that, flying OUR flag is offensive............WOW.

Wait, I thought the flag was a divicise symbol of the Bush Administration? Hasn't all of that changed with Obama - the flag is cool again.

What if it was one of those new fangled Obama flags?

We're told the ban includes sports flags and even flag stickers on cars.

WHAT? Flag stickers on cars?

This is a free speech issue. What strikes me about this is that this isn't a homeowners association where you sign on to bylaws. These are RENTERS.

Kiss my arse, I not only wouldn't take anything off or down, I'd take them to court if they hassled me.

In a slighly related matter municipalities can control items you post that are visibible from your vehicle. For example, Los Angeles Municipal Code 80.72.5 " (e) No person shall stand or park a vehicle upon any street for the purpose of displaying such vehicle for sale by sign or otherwise. (Amended by Ord. No. 134,523, Eff. 7/17/67.) The intent of the law is that such signs are a distraction to other drivers.

You say "take them to court." Under what grounds? And how many renters have a spare $10,000 to hire a lawyer to sue over this issue?

As for the tenant being a renter, and not an owner under an association, one still has to look to the rental agreement to determine if the landlord might have reserved the right to regulate signs on apartments and vehicles.

But this is NOT a freedom of speech issue. It is a private person or association making the decision. The remedy is simple. Either take it down or risk being evicted. Then you enter the question of terms of lease or rent. If you are being evicted unlawfully you fight it in court. The landlord will probably have an attorney meaning the tenant should also get one. Again, this can be very expensive. And don't expect the landlord to be truthful. When it comes to evicting a tenant landlords are known to make up all sorts of stories including the tenant created distubances by loud noise, slamming doors, etc.

While on the face of it there is an anti-American implication, the rule is general in nature:
We're told the ban includes sports flags and even flag stickers on cars.So if you allow the American flag, you have to allow all others including the half moon and crescent, the Mexican flag, the white power flag, the flag of Israel, the gay pride flag, etc. To allow the American flag and NO OTHER flags would be discriminatory and while it might be "legal", enforcement of the rule would almost certainly lead to confrontations and problems.

Im my former condo the association had a rule. Flags of countries could be hung on the patio so long as the tops of the flags were no higher than the top of the patio fences. No other flags or signs of any kind (even "for sale" or "rent" signs) could be hung or displayed from the windows or on the outside of the individual unit. I actually voted for this rule and the reason was that our 800 unit+ complex had become an ugly mess of signs. One guy had hung a huge surfing flag that covered the entire front of his unit. The place had become an eye sore. So over 90% of the owners voted for the rule and, unfurtunately, there was no way to exempt the American flag at the espense of everything else. Even on that issue many residents had hung American flags and left them there to rot. Many were covered with spider webs, others hanging in pieces after being destroyed by the elements.

Just watched video of the update on the original website. They showed an interview with the manager (with her face OFF camera) who said that she didn't care about the public's reaction but that it was pointed out to her that what she was doing was illegal and that is why she lifted the ban.

Old biddy, I"d move anyway.
