Is Owning "Pretty Baby" with Brooke Shields a Crime?

There is currently a News Story about a photo taken of Brooke entirely Nude when she was under age and it was removed from an Exhibit because of those Concerns.

She appears entirely Nude and if I am not mistaken, in Sexual scenes when she was about 12 Years Old.

Hell, I think Cable runs it and you can rent it at the Video Store... Even PBS played the uncut version of it a few years back and discussed the issue.

Anyone got Netflix that can check?

Anyway, is it?… Should it be?

Where is the Line?

Pretty Baby is Pretty Questionable Considering she was 12ish...

Yet it is still for Sale, as far as I Know and PBS has Aired it via our Tax Dollars.

So why is the Photo a Problem?...

Britain's Tate Modern gallery said on Thursday it had closed a room at its new blockbuster exhibition that contains a naked image of actress Brooke Shields aged 10, after police launched an investigation.

The image, taken by artist Richard Prince in 1983 from another photograph, shows the U.S. star posing nude in a bathtub wearing heavy make up. Police are considering whether the image breaches obscenity laws. "Officers from the Metropolitan Police Service Obscene Publications Unit met with staff at the Tate Modern on September 30 regarding an image which was part of an exhibition due to open at the gallery on Thursday, October 1," police said in a statement.

Tate said the room, which contains only the Shields image, had been temporarily closed, but the rest of the show, featuring other sexually explicit work including a video of an artist having sex with a collector, would open as normal.

"We're in discussion with police at the moment," a spokeswoman for Tate Modern said.

It's Actual Video of her, not only Nude, but Portraying Sex at about the same Age.

I don't get how this Video, Considering the Obcenity Laws and Child Porn Laws, is still Available.

Typically, child nudity is permissible when it's associated with actual artistic expression. You'll get the occasional D.A. or Wal-Mart photo tech that wants to make an issue of it.

You can get prosecuted for owning or selling Tracy Lord's porno.
She confessed that she was under age when she made them.
Women in the industry claimed she was so sophisticated and "professional" that they never suspected she wasn't over 18.

there was nothing simulated or artistioc about it........


i do have to say that she was very VERY good at it.........


although i think it was just considered underage porn as oipposed to child porn... child porn i think they have to be prepubesent...... and traci definately wasnt pre pubesent.......

General rule is nude photos are not illegal.

Photos depicting sexual activity would be child porn. Photos depicting sexually suggestive poses could be child porn.

Traci hoodwinked the producers of her videos with fake ID and even a fake passport.

There is no grandfather clause except to the ex post facto laws against buying an selling since any new laws would not be retroactive EXCEPT to possession and new sale or transfer.

In sure there are plenty of Lord's vids carefully hidden away, but they were illegal THEN and are illegal NOW. Let me give a better example. You go to a market and buy sugar. You get home and find you bought a bag of cocaine. You keep it. You did not buy it knowing it was cocaine. But once you learn what it is possesssion becomes illegal. Mistake of fact would only be a defense UNTIL you learn the item is contraband.

The question is if the other "actors" were guilty of statutory rape (considering age of conscent where the film was shot.) since ingnorance of age is never accepted as an excuse.To be more concise they were not charged with child porn but lewd act on a child (one can be guilty if only producing or directing the sex act). This is normally a strict liability offense under today's law and mistake of fact (i.e. mistake of age ot a defense). However, the reason the charges were dropped in THIS case was because Lord's conduct was so manipulative and her fake ID's so realistic that no jury would convict.

BTW Lords (Nora Louise Kuzma) used to live on the same street where I now live, although I only moved here 6 years ago. Maybe I should do some digging in her old back yard hehehe.

So, laws about under age porn etc. do not apply to the original movies today. Other porn before a certain year (don't really know the year) are not covered under newer laws that relate to porn. Look up the disclaimers for such film as Deep Throat and films done int he 1970s or so.

For what it's worth, (and I doubt it's worth all that much) in "The Blue Lagoon" Brooke Shields nude scenes were done by body doubles. The stuff in "Pretty Baby", however, was all her. I've seen the movie and remember a few nude scenes, but I don't recall anything that was explicitly sexual.

Pretty Baby was a pathetic movie. Poor acting, accents that were laughable,
story line that bordered on boredom, and the only reason it ever got made was
because some hollywood deviants figured that there would be a market of
pedophiles if they made a film showing some nudity involving pre-teen girls.
