So, I'm leaving Wally World today after picking a few canning necessities. As I'm pulling up one of the aisles, someone backs out of his space right into my car. In fairness to him, our view of each other was blocked by an SUV to his immediate right. So, I get out of my car and we politely exchange information. He is very apologetic about it and admitted that it was his fault. So, my reply to him was, "it's no big deal, **** happens". Now, my theory is that I'm just one or two seconds of inattentiveness away from doing the same thing. And if I did, I wouldn't want some raving lunatic telling me how stupid I am. So, I try not to over react when things like this occur. I was polite and friendly as we exchanged information. I went home and called "the Lizard" (my insurance company) and told them what happened. They in turn called the strange chick with the heavy make up (his insurance company) and said that he was in the middle of filing his claim. All is well and good until I get the call from his company and found out that the guy who was all apologetic at the scene told them that he thought that the accident was my fault because since he didn't see me, I had to have been speeding through the lot. *sigh*

Now I really don't have any doubt that when they review the footage from the security cameras at Wally World that I will be vindicated, but it just really ****es me off that he wouldn't take responsibility for his mistake and tried to lay the blame on me.

First off...you did the right thing. You were mature, a level headed adult who dealt with a cruddy situation as best you knew how. Good on ya!

Second: ..and this is a biggie...People will say or do just about anything to stave off confrontation. So..although it's no surprise this guy genuflected and bowed and stated his apologies to you...once he got on the phone...and his safety was insured..he became...Dah da Dah..Phone Warrior! ;) Gross as it is to say..most people today would have done what this guy did. Sad..very sad state of affairs.

You'll be vindicated...they guys insurance company will pay...and all will be right in the land of Oz once more. Suggestion for next time: When the driver of the other car 'admits' they are at fault...right it up on a piece of paper and have them sign that they are as fault/blame. See how readily they are willing to admit fault then. ;)

Are you ok btw? May feel a bit bruised up tomorrow..so watch for signs of soft tissue damage. Go in Monday to your doc if need be.

It's also not a bad idea to head down to the cop shop and fill out an accident report.

Isn't that only if the accident meets a certain dollar amount in damage? I remember somewhere in our dmv code that unless 500 dollars in damage is noted, no police report is required? Should you go ahead and report it anyway even if it doesn't met the damage amount?

Just curious....

Police showed up, since it was on private property and we exchanged information, he said that he would not file a report.

Anytime you're planning on involving insurance co.'s it's a good idea to fill one out. And if god forbid you end up in small claims it's always nice to have something on paper that the other guy doesn't.

Wow. I didn't realize that being on private property would make a difference.

Yeah, a guy hit me once in a parking lot, I called the police and he told me about private property, I didn't have any problems though.
