Id really like to know this. They call it plea bargaining. I was in court the other day and some spanish guy was accused of harrasment or something. They told him just plea to jay walking and pay the fine. He said ok. So the judge asks him on such and such a date at such and such a time in the town of so and so jay walk. He said no. The Judge went nuts, He said Im under oath I cant swear to that through his interpreter. The whole court room broke out in laughter.

In reality many times its no more than extortion. My lawyer told me its not whether your innocent or guilty but what they can threaten you with. Lots of times they make the fine less than what it would cost you for the lawyer and the lawyer tells you to just take a plea and pay the slly fine.

The court system is overloaded, and it saves money and prison space to have people plea out.

Also, prosecutors often don't give a rat's ass if somebody is really guilty or not, they see a conviction as some sort of perverted point of pride, or as a star on their "record".

I have absolutely ZERO respect for most prosecutors. They generally don't give a damn about justice, its all about them and their "record".

Because there aren't enough trial slots, so any halfway competent defense attorney knows that unless they're defending a murderer or a criminal that made the news, the prosecutor has virtually no chance of getting a trial slot.

The legal system would collapse in forty-eight hours if ninety percent of cases weren't plea bargained.

But doent this make a joke of our legal system? And your way wrong on getting a trial slot. They will indite you real easy. In fact they offered me a deal and when my lawyer asked to see what evidence they had against me they told her if you want to see the evidence were going to drop the plea. What kind of crap is that?

They were bluffing most likely.

And the saying is, "A prosecutor can indict a ham sandwich" for a reason.

I happen to know a lot of prosecutors. Every one of them is just trying to do the right thing. In fact, most of the time I'm giving them a hard time about giving the courthouse away.

Bluffing huh? Well heres my deal. Their offering me to pay 800 bucks to the charity of my choice. My lawyer says they have pretty much no case against me and theres only a 5 or 10% chance any jury would find me quilty. However if they do I get 3 years upstate. I will also have to go to court for who knows how long. Ive already been going to court on this matter for over a year now. And it will cost me 4000 dollars for the lawyer. This is what they count on. Now I have to go before a judge and lie and this is the norm as far as i can see. My lawyer asked me the other day if I would have a problem swearing in front of the judge. I told her no Im a good liar :D She said she couldnt take my plea then as their not in the habit of taking false pleas lol. I said then Ill get another lawyer.
