So I know a person that got arrested last weekend and blew a .10. DUI for sure. Stupid Idot for sure. Now the problem is the police didn't read him his Maranda Rights at the time of hand cuffing nor did they in Jail. His BAC was .089 at the station. Did the police mess up by not reading his Maranda Rights? I always thought that some time during the process they had to. Help out.

If he was drunk maybe he doesn't remember that his rights were read?

This corroborates what happened the two times I was popped for DUI.
But they have to read you your right in booking though.

But they have to read you your right in booking though.The Miranda reading is for your protection. All this means is that anything said AFTER being arrested is not admissible unless & until the Miranda rights are read.
In the case of a DUI, they have the BAC - they don't need anything else that they would get from an interrogation so they didn't bother with the reading.
