LOS ALAMITOS, Calif. - The mayor of a California city says he will resign after being criticized for sharing an e-mail picture depicting the White House lawn planted with watermelons under the title "No Easter egg hunt this year."

He resigned. He could have stayed. Read what the first Amendment says,

He resigned. He could have stayed. Read what the first Amendment says,

maybe read it...not it is saying the government can not limit a persons free speech. so a person can not violate another person's 1st amendment rights.

oh I have an you are basically stating you are not protected under it though and someone can fire you because of what you say or send that they may not agree with.......

It makes zero difference. If we assume he has the right to send that photo that means he can not be criminally charged with that act.

The response to his act falls in to free speech. He could have refused to leave and maybe nothing could have been done--Well not until election day. By the tone of your posts: it would be wrong for a voter to use that email as a factor in how they chose to vote.

Now he may not have had the right to send it: if it was sent form a government computer or with his government email then it could be a violation of laws regarding racial discrimination--which is NOT a form of protected speech.

Anyway freedom of speech is not freedom from consequences. His only apparent consequence was some negative public statements of opinion.

Oh and FYI: If you worked for me and you sent that photo and I found out: I would fire you on the spot and that would be 100% legal.

Under those circumstances, I don't think your firing would stand up in court. But I could be wrong.

In his defense, we don't have the complete email to see if in fact there were any references in it to the 'budget plan'. If not, take your lumps Mr. Grose. If so, make a case and don't resign.

One of the problems, from what I understand, the Mayor is chosen by five city council members and the position is mostly ceremonial.

That doesn't mean that an employee fired by you for sending that picture out on their personal computer couldn't (and wouldn't) file suit against you and cost many $$ in legal fees for your trouble.

They could and they would. At-will state or not, doesn't mean you won't find yourself in front of a judge explaining yourself to him/her. Just like a prosectuor can indict a ham sandwich, an attorney and a client can also sue a ham sandwich. All it takes is an attorney willing to work on a contingency basis, the price of the filing fee, a process server and a small amount of paperwork.

I imagine in these tough economic times, the courts are full of people looking for a big payday in court. Don't think it can't (or won't) happen to you.

Tread very carefully in your hiring and firing decisions.
